Delawarepark.com End-User License Agreement

The Delaware State Lottery offers its internet lottery services through its authorized video lottery agent Delaware Racing Association (the “Video Lottery Agent”) and through the Video Lottery Agent’s "delawarepark.com" brand (the "delawarepark.com Brand"). In addition to offering its internet lottery services via the internet (the "Internet Platform"), the Delaware State Lottery may from time to time offer its services through the Video Lottery Agent’s delawarepark.com Brand via alternative platforms such as (i) interactive television and (ii) mobile gambling platforms (each, an "Alternative Platform").
When you use the Delaware State Lottery’s internet lottery services on the delawarepark.com Brand either via the Internet Platform or an Alternative Platform, this End-User License Agreement (the "Agreement") shall apply to such use to such extent as is applicable to the circumstances. When used in this Agreement, the terms “we” “our” and “us” mean the Delaware State Lottery and the Video Lottery Agent, and their respective directors, officers, employees and agents. In addition, as used in this Agreement, the term "service provider" means an entity or a person which provides any service in connection with the internet lottery services, including without limitation, provision of software components on the Internet Platform or the Alternative Platform, customer support and other customer facing services as well as one or more of the games provided on delawarepark.com.
In addition to the Agreement and the Privacy Policy, your use of the Delaware State Lottery’s internet lottery services is strictly subject to all additional rules and policies which shall apply from time to time to the type of gambling services which you are using on the delawarepark.com Brand, including, but not limited to, the "Bonus Policy", the "Withdrawal Policy" the "Responsible Gaming Policy" the Location Verification Terms & Conditions and the "House Rules" (together the "Additional Rules") in each case as updated from time to time.
1. Introduction
By registering with the Delaware State Lottery and/or by using the Delaware State Lottery’s internet lottery services and/or by marking the "I have read and agree to the terms of the End User License Agreement" box below (or any other similar wording) and/or clicking on the "Continue Download" button, you agree to be bound by this Agreement in its entirety and without reservation. As such, this Agreement constitutes a binding legal document between you and the Delaware State Lottery and the Video Lottery Agent; and together with the Additional Rules which are deemed to be an integral part hereof, this Agreement shall govern your use of our gambling services at all times.
All transactions between you and us take place in the State of Delaware.
The software offered by the Delaware State Lottery, the Video Lottery Agent, and service provider via the delawarepark.com Brand, which is available in both download and no-download forms (the "Software"), allows you to use our internet lottery services via the delawarepark.com Brand (the "Services"). We reserve the right to suspend, modify, remove or add to the Services in our sole discretion immediately and without notice. We shall not be liable for any loss suffered by you resulting from any changes made and you shall have no claims against any of us in such regard. As used in this Agreement, the term “Internet Lottery Regulations” means all statutes, regulations and rules applicable to the Services or your use of the Services.
In respect of your use of the Services, you may only have one account on the delawarepark.com Brand for which you will register using your own actual name. You shall access the Software and use the Services only via your own account and you may never access the Software or use the Services by means of another person's account. Should you attempt to open more than one account on the delawarepark.com Brand, under your own name or under any other name, or should you attempt to use the Services by means of any other person's account, we will be entitled to immediately close all your accounts, retain all monies in such accounts and bar you from future use of the Services.
2. Acceptance of Terms and Conditions
If you do not agree to any of the provisions of this Agreement you should immediately stop using the Software and remove the Software from your computer.
We reserve the right to amend, modify, update and change any of the terms and conditions of this Agreement (including each of the Additional Rules) from time to time and we will notify you of any such amendment, modification or change by publishing the new version of this Agreement on the relevant page of this Internet site (this "Site"). Any modified version of this Agreement will take effect 14 days after its publication on this Site and your continued use of the Services or the Software after the aforementioned 14 days will be deemed to constitute your acceptance of the changes to this Agreement. It remains your responsibility to ensure that you are aware of the correct, current terms and conditions of this Agreement and we advise you to check for updates on a regular basis. PLEASE NOTE: We take our responsibilities in relation to your privacy exceedingly seriously and therefore changes to the Privacy Policy are governed by the modification provisions found therein.
3. Location Verification
Use of the Services is restricted to users who are playing from within the State of Delaware. You represent, warrant and agree to ensure that your use of the Software and the Services will complyat all times with all applicable laws, statutes and regulations.
You acknowledge that you will be physically within the State of Delaware during any time of play and you will comply with our requirements in connection with verifying your physical location at time of play.
We may verify the location of the device on which you are accessing the Services (the “Device Location Service”). The Device Location Service relies on WiFi or GPS signals to determine the geographic location of the device on which you are accessing the Services. Your device must have WiFi or GPS capability. You will not be able to play for real money on the Services from a device that does not have WiFi or GPS capability, or on which the WiFi or GPS (as applicable) has been disabled.

We shall not be responsible for any illegal or unauthorized use of the Software and/or the Services by you. Please consult an attorney if you have any doubts about the legality of your use of the Software and the Services under the laws of any jurisdiction that applies to you. By accepting these terms, you agree to assist us, to the extent you are able, with its compliance with applicable laws and regulations.
Persons located outside of the State of Delaware, at the time of their activity, may not use the Services for real money play.
Under no circumstances will we nor any of our affiliates or third party service providers and their respective affiliates be responsible or liable in any respect for any losses you may incur as a result of your location not being able to be properly verified for any reason. By using the Services, you understand and agree that such responsibility or liability is borne exclusively by you.
4. Permitted Participation
Upon registration you will be required to provide your full name, date of birth, address, cellular phone number, e-mail address and social security number (if you are a resident of the United States of America) or passport details (if you are not a resident of the United States of America) as well as a confirmation that you are not self-excluded from internet lottery gaming, that you are not on the Licensed Video Lottery Agent or State of Delaware’s exclusion list in relation to internet lottery and video facilities ("State Exclusion List") and that you are not on any other list of excluded persons (together the "Registration Details"). By accepting this Agreement you affirm that the Registration Details provided upon registration are accurate.
No-one under the age of 21 ("Legally of Age") may register, download the Software or use the Services under any circumstances and any person not Legally of Age who downloads the Software or uses the Services will be in breach of the terms of this Agreement. Your use of the Software or of the Services is subject to the verification of your age, as required by Delaware State Lottery and the Delaware State Lottery reserves the right to request additional proof of age at any stage, including (but not limited to) by means of a voice sample, to verify that persons not Legally of Age are not using the Services. The Delaware State Lottery will cancel a person's registration process or account and exclude a person from using the Software or the Services if their age can’t be verified or if the Delaware State Lottery suspects that a person using the Software or the Services is not Legally of Age.
Until such time as your Registration Details have been completed in accordance with the Internet Lottery Regulations and accepted by us, you may not deposit any funds into your account or play any real money games. Once your Registration Details have been completed in accordance with the Internet Lottery Regulations and accepted by us, you may deposit funds into your account from any location in compliance with all applicable laws and regulations in your jurisdiction.
No one not physically present in the State of Delaware may use the Services for real money play. We will verify your physical location when accessing the Services upon every login to the real money play casino or poker offerings. In the event that we are unable to verify your physical location we will suspend your access to real money play even if the inability to locate your physical location is due to an error in or malfunction of the Internet Platform or Alternative Platform not attributable to you. By accepting this Agreement you affirm that you are prohibited from engaging in interactive gaming from any location not physically within the State of Delaware and grant us your consent to monitor and record your physical location information for such purpose.
We will verify your Registration Details, including (but not limited to) name, address, age, e-mail address social security number (if you are a resident of the United States of America) or passport details (if you are not a resident of the United States of America) and payment methods used, during the registration process and at any other time we see fit, through online real time registration verification for US residents and if needed, by requesting certain documents, and in accordance with the requirements set forth in Delaware Law and the Internet Lottery Regulations. These documents, where required, will typically include an identity card, proof of address such as a utility bill, and proof of your payment method, and can be sent to us through the 'Upload Your Documents' feature in your Cashier. If deemed necessary, we may request that the said document copies are notarized, meaning that the documents are stamped and attested by a Public Notary. In the event you do not complete our requests for documents and/or you fail the online verification procedures, we may in our sole discretion terminate the account and withhold any funds that are present therein. Should the documents fail our internal security checks – for example, if we suspect that they have been tampered with, or are in any way provided to mislead or misrepresent – we are under no obligation to accept such documents as valid, and under no obligation to provide feedback on the exact nature of our findings with regards to these documents.
We reserve the right to perform background checks on you, for any reason, including (but not limited to) any investigation into your identity, any credit checks performed on you, or any enquiries into your personal history. The basis for such investigations will be dependent on the specific case, but could include (but is not limited to) verification of your Registration Details, such as the name, address and age, verification of your financial transactions, and verification of your internet lottery activity. We are under no obligation to advise you of such an investigation taking place. Such activities may include the use of specific third party companies, who perform the investigations as required. We may decide at our sole discretion to terminate your registration process, suspend your account and withhold all funds, on the basis of such an investigation and its positive outcome.
5. Information Technology/Intellectual Property
The Delaware State Lottery and the Video Lottery Agent hereby grant you the non-exclusive, non-transferable, non-sub-licensable right to install and use the Software and all content derived from the Software, including, but not limited to, the copyright and all other intellectual property rights therein, in connection with the Services in accordance with this Agreement. You may install the Software on a hard disk or other storage device and may make back up copies of the Software, provided that such back up copies are used only by you in connection with the Services through a computer of which you are the principal user. The Software's code, structure and organization are protected by intellectual property rights. You must not:
a. copy, redistribute, publish, reverse engineer, decompile, disassemble, modify, translate or make any attempt to access the source code to create derivate works of the source code, or otherwise;
b. sell, assign, sublicense, transfer, distribute or lease the Software;
c. make the Software available to any third party through a computer network or otherwise;
d. export the Software to any country (whether by physical or electronic means); or
e. use the Software in a manner prohibited by applicable laws or regulations (together the "Prohibited Activities").
You will be solely liable for any damage, costs or expenses arising out of or in connection with the commission of any Prohibited Activities. You shall notify the Delaware State Lottery immediately upon becoming aware of the commission by any person of any of the Prohibited Activities and shall provide the Delaware State Lottery with reasonable assistance with any investigations it may conduct in light of the information provided by you in this respect.
The trademarks, service marks and/or trade names used by the Video Lottery Agent, including, without limitation, the delawarepark.com Brand are the property of the Video Lottery Agent or one of its licensors. The trademarks, service marks and/or trade names used by the Delaware State Lottery on its own behalf from time to time are the trademarks, service marks and/or trade names of the Delaware State Lottery or one of its licensors (all such trademarks, service marks and/or trade names are collectively referred to herein as the “Trade Marks”) and these entities reserve all rights to such Trade Marks. In addition to the rights in the Trade Marks, the Delaware State Lottery, the Video Lottery Agent, and their licensors own the rights in all other content, including but not limited to the Software, images, pictures, graphics, photographs, animations, videos, music, audio and text available via the Software or on the Internet (the "Site Content") and the Site Content is protected by copyright and/or other intellectual property rights. You hereby acknowledge that by using the Services or the Software you obtain no rights in the Trade Marks or the Site Content and you may only use the same in complete accordance with this Agreement.
6. Your Representations and Undertakings
In consideration of the rights granted to you to use the Services and the Software, you represent, warrant, covenant and agree that:
You are Legally of Age as defined in this Agreement, you are of sound mind and you are capable of taking responsibility for your own actions.
All Registration Details and other documents and information provided by you to the Delaware State Lottery and/or the Video Lottery Agent, either during the registration process or at any time thereafter, including as part of any payment deposit transaction, are true, current, correct and complete and match the name(s) on the credit or other payment methods to be used to deposit or receive funds in your account. Without waiving or limiting the foregoing, if you use a credit card or any other form of payment or withdrawal which is not in your private and personal name, we will presume that you have received complete and sufficient consent from the rightful owner and/or the person whose name is used on such payment instrument to make use of such payment instrument for the purposes herein, prior to your engagement with us. You acknowledge that any authorizations or declines in connection with your use of such credit card are subject, inter alia, to rules and regulations of various banking institutions. We shall not be obligated in any manner to examine such consent and shall bear no responsibility with respect to your representations hereunder or any authorization or decline of the relevant transaction. You will promptly notify us of any changes to any information previously provided by you to us. From time to time you may be requested to provide us with certain documents to verify the details of the credit card used by you to deposit money to your account. Depending on the outcome of these verification checks you may or may not be permitted to deposit further monies with the credit card previously used by you. Should any of the information that you provide to us be untrue, inaccurate, misleading or otherwise incomplete, you will be in breach of this agreement and we reserve the right to terminate your account immediately and/or prevent you from using the Software or the Services, in addition to any other action that we may choose to take. We reserve the right to refuse any deposit transaction at any time for any reason without explanation.
You have not excluded yourself from internet lottery gaming or are on the State Exclusion List.
You hereby grant us your consent to monitor and record your wagering details at all times and you shall have no claims against us in such regard.
Your account with the Delaware State Lottery and the Video Lottery Agent is solely for your benefit and you shall keep your password and log-in ID securely. You shall not allow any third party (including a relative) to use your account, password, log-in ID or identity to access or use the Services or the Software and you shall be fully responsible for any activities undertaken on your account by a third party. You will not reveal your account username or password to any person and you shall take all steps to ensure that such details are not revealed to any person. You shall inform us immediately if you suspect that your account is being misused by a third party and/or any third party has access to your account username or password so that we may investigate such matter, and you will cooperate with us, as we may request, in the course of such investigation.
You are responsible for the security of your username and password on your own PC or internet access location. If this username password combination is “hacked” from your computer, due to any viruses or malware that is present on the computer that you access your account with, or through any other activity which does on not take place on equipment which is under our exclusive control, this is your responsibility. You should report any possible hacking attempts or security breaches immediately to us.
You fully understand the methods, rules and procedures of the Services and Internet gambling in general. You understand that it is your responsibility to ensure the details of bets and games are correct. You will not commit any acts or display any conduct that damages the reputation of the Delaware State Lottery.
You are fully aware that there is a risk of losing money when gambling by means of the Services and you are fully responsible for any such loss. You agree that your use of the Services is at your sole option, discretion and risk. In relation to your losses you shall have no claims whatsoever against the Delaware State Lottery.
You acknowledge that in registering and using the Services you have to provide us with certain personal details about yourself (including details regarding your methods of payment). We shall handle all information provided by you diligently and we will not disclose such information to third parties except as provided for in the Privacy Policy. We urge you to read the Privacy Policy to ensure that you agree with our policies in relation to how your information is handled.
You shall use this Site, the Services and the Software in complete accordance with the terms and conditions of this Agreement and each of the Additional Rules, all as amended from time to time, and you shall abide by all of the rules and instructions for playing the games that comprise the Services.
You are solely responsible for recording, paying and accounting to any relevant governmental, taxation (including but not limited to federal or state taxation) or other authority for any tax or other levy that may be payable on any winnings paid to you.
You are solely responsible for any telecommunications networks and Internet access services and other consents and permissions required in connection with your use of the Software and the Services. You shall use the Services and the Software only in good faith towards the Delaware State Lottery, the Video Lottery Agent, service provider and other players using the Services. In the event that the Delaware State Lottery, the Video Lottery Agent, or the service provider deems that you have been using the Services or the Software in bad faith, we shall have the right to terminate your account with the Services and any other account that you may hold with the Delaware State Lottery and any of its video lottery agents, and the Delaware State Lottery shall be entitled to retain all monies therein. You hereby expressly waive any future claims against the Delaware State Lottery, the Video Lottery Agent or the service provider in such regard.
As the end user, you acknowledge that certain games and tournaments, which are included in the Services, are offered to you on a "shared basis" which enables the Video Lottery Agent to bring together users of the Services with other people who are not users of the Services. You agree that, at the Delaware State Lottery’s sole discretion, you may be pooled into these shared games and tournaments. In such cases, you accept that you may play with or against other people, who may have different configurations to your own, this includes but is not limited to different bet limits. To the extent that you breach this Agreement, the Video Lottery shall have the right to suspend you from playing on any games and tournaments.
You acknowledge and agree that should you choose to self-exclude from this Site, self-exclude in accordance with the Internet Lottery Regulations or are on the Self Exclusion List you shall not be permitted to open or use a new account with any other website owned or operated by the Delaware State Lottery (the "Other Sites") during your selected self-exclusion period, until such self-exclusion has been lifted (if applicable) and the original account reopened. In the event you are in breach of the foregoing, we shall be entitled to suspend any new account you open with any Other Sites, forfeit any funds you may deposit (or have previously deposited) therein, and shall not be liable to refund to you any funds you may have wagered or won through such account.
You acknowledge that in relation to peer-to-peer gaming, you may be at a disadvantage in relation to other players as a result of technical issues, such as slower network speeds or slower end user device performance.
7. Prohibited Uses of the Sites and Services
Illegal Funds and Unlawful Activities: You declare that the source of funds used by you for gambling on the Site is not illegal and that you will not use the Services in any way as a money transfer system which shall include but not limited to the transfer of funds between accounts held with different Internet lottery agents or the transfer of funds between players. You will not use the Services for any unlawful or fraudulent activity or prohibited transaction (including money laundering) under the laws of the State of Delaware. If we have a suspicion that you may be engaging in or have engaged in fraudulent, unlawful or improper activity, including, without limitation, money laundering activities, or conduct otherwise in violation of this Agreement, your access to the Services may be terminated immediately and/or your account suspended. If your account is terminated or suspended in such circumstances, we are under no obligation to refund to you any funds that may be in your account. In addition to terminating your access to the Services and/or suspending your account, we reserve the right to prevent you from accessing any of the Delaware State Lottery's other websites or servers or any other website which it operates or accessing any other services offered by the Delaware State Lottery. We shall be entitled to inform relevant authorities, other online service providers and banks, credit card companies, electronic payment providers or other financial institutions (together "Interested Third Parties") of your identity and of any suspected unlawful, fraudulent or improper activity. In the interests of fair play it is prohibited to utilize any recognized betting techniques to circumvent the standard house edge in our games. If the game play on your account indicates that you are using such betting techniques We shall immediately suspend the account and retain any funds in said account. As the End User, You agree to cooperate fully with the us to investigate any and all such activity.
Circumvention: We have developed and employ sophisticated proprietary technology intended to seek out and identify users making fraudulent or unlawful use of the Services or Software. You shall not break into, access or attempt to break into or access or otherwise circumvent our security measures. If we believe, in our sole discretion, that you are in breach of this clause, we may terminate your access to the Services immediately and/or have your account terminated or suspended, pending investigation, and/or notify the proper authorities of the suspected activity, which may result in the closure of all your accounts, and you being barred from future use of the Services. We reserve the right to inform Interested Third Parties of your breach. If your account is terminated or suspended in such circumstances, we are under no obligation to refund you any of the funds that may be in your account, with such funds being forfeited by you. In addition to terminating your access to the Services and/or suspending your account, we reserve the right to prevent you from accessing any of our other websites or servers, or accessing any other properties or services offered by us.
Software Aids: The use of any automated tool which in our opinion is designed among other things to provide assistance in betting decisions, to exchange the opponents' hand histories, to enable you to find a seat at a poker table, to automatically seat You at a poker table or which is used in any way in connection with your use of the Services is strictly prohibited. Therefore, the use of any software, program, tool, or robot which in our opinion is endowed with artificial intelligence or any external devices, programs or applications (hereinafter referred to as " Software Aid") in connection with your use of the Services is strictly prohibited. We constantly review the use of the Services in order to detect the use of any Software Aid and in the event that we deem it has been used, we reserve the right to take any action we deem fit, including immediately suspending access to the Services to the offending user and terminating such user's account. If your account is terminated or suspended in such circumstances, we are under no obligation to refund you any of the funds that may be in your account, with such funds being forfeited by you.. If the Delaware State Lottery is informed about any suspected Software Aid, it may, in its sole discretion, terminate suspected players' access to the Service and/or suspend their accounts and all monies in such player's account. In addition to terminating your access to the Services and/or suspending your account, we reserve the right to prevent you from accessing any of our other websites or servers, or accessing any other properties or services offered by us.
Intentional Disconnection: You may not intentionally disconnect from a game while playing on the website. If, in our sole discretion, you are in breach of this clause, we may terminate your access to the Services immediately and/or have your account suspended. We shall be under no obligation to refund you any monies that may be in your account, with such funds being forfeited. In addition to terminating your access to the Services and/or suspending your account, we reserve the right to prevent you from accessing any of the our other websites or servers, or accessing any other properties or services offered by us..
If we have reason to suspect that an account or group of accounts are operating systematically in order to gain an advantage over another player or to commit an act in bad faith in relation to other players or us – for example employing specific wagering techniques to disadvantage other players or wagering as a group, we shall have the right to suspend or terminate all accounts and in such circumstances, we shall be under no obligation to refund you any funds that may be in your account, with such funds being forfeited by you.
We will not provide any information to you with regards to investigations or any subsequent outcome which it conducts into your use of the Services.
8. Your Account
Your account is for your sole personal use only and shall not be used for any professional, business or commercial purpose.
We take no responsibility for any third party access to your account and under no circumstances shall we be liable for any losses incurred by you as a result of misuse of your password by any person or for any unauthorized access to your account and all transactions where your user name and password have been entered correctly will be regarded as valid, whether or not authorized by you.
Monies held in your account shall not earn any interest.
Should you fail to use your account for 5 years your account will be considered "inactive". In the case of such an inactive account, the account shall be treated in accordance with Title 12, Chapter 11, Sub-chapter II of the Delaware Code relating to abandoned and unclaimed property. The period of inactivity shall run from the date you last logged on to your account.
We may, at any time, set off any positive balances in your account against any amount owed by you to us.
We reserve the right, to be exercised in our sole discretion, to limit or refuse any bet, stake or other wager made by you or through your account.
Where the Software uses a third party application interface, not all the information relating to your past gambling activities will be displayed online.

9. Payment Transactions and Payment Fraud
Each user of the Service is fully responsible for paying all monies owed to us. You agree that you will not make or attempt to make any charge-backs, and/or deny or reverse any payment that you have made. You will reimburse the Delaware State Lottery for any charge-backs, denial or reversal of payments made in connection with your account and any loss, cost, fee, penalty or expense (including, without limitation, attorneys’ fees) suffered or incurred by the Delaware State Lottery as a consequence thereof. We may, at our sole discretion, cease to provide the Services or withhold payment to certain players or to players paying with certain credit cards.
You shall only be able to deposit funds into your account via credit card, bank transfer or via any other approved means. Furthermore, you will only be able to withdraw funds from your account by bank transfer, bank draft or via any other approved means.
We reserve the right to run credit checks on all players with third party credit agencies, on the basis of the information provided to us on registration.
We reserve the right, to be exercised in our sole discretion, to refuse any deposit transaction at any time for any reason without explanation.
By submitting a bank ACH transfer ("ACH Transfer") to us, you authorize us or our designee to obtain a consumer or other report on you from a consumer reporting agency. We use Global Payments Gaming Services, Inc. (“Global Payments Gaming”) for this purpose. We may use this report, and other information available to us, to assess your eligibility for processing an ACH Transfer. The eligibility criteria we apply will be established in our sole discretion, and may change from time to time without notice to you. We will make an eligibility assessment, and obtain a consumer or other report on you, each time that you transmit an ACH Transfer.
You are solely responsible for any fees imposed by a bank for a stop payment order on a check issued to you which is not cashed or for any other bank fees which may be imposed in connection with cancelled transactions or uncollected fees.
Registration data and certain other information about you are subject to our applicable privacy policy. You understand that through our use of Global Payments Gaming's services you consent to the collection and use (as set forth in the applicable privacy policy) of this information.
We reserve the right to use third party electronic payment processors and/or financial institutions to process payments made by and to you in connection with your use of the Services. To the extent that they do not conflict with the terms of this Agreement, you agree to be bound by the terms and conditions of such third party electronic payment processors and/or financial institutions.
In the case of suspected or fraudulent payment, including use of stolen credit cards, or any other fraudulent activity (including any charge-back or other reversal of a payment), we reserve the right to suspend a player's account, reverse any pay-out made and recover any winnings. We shall be entitled to inform any relevant authorities or entities (including credit reference agencies) of any payment fraud or otherwise unlawful activity, and may employ collection services to recover payments. However, under no circumstances shall we be liable for any unauthorized use of credit cards, irrespective of whether or not the credit cards were reported stolen.
Our expectation is that you will deposit in order to actively play with your own funds. We reserve the right to enforce a wagering amount on your deposited funds, before allowing any withdrawal from said account. This wagering amount will be a multiplication of the total deposited funds, which we will specify depending on the case (for example 1 x the deposited amount). If you have both Available Funds and Restricted Funds in your account, the next wager you make will use Restricted Funds first. 11. Obligations of the Delaware State Lottery and the Lottery Agent
Except as detailed in this Agreement, the Delaware State Lottery, and the Video Lottery Agent have no obligation to check whether players are using the Services in accordance with this Agreement or the Additional Rules, as updated from time to time. The Delaware State Lottery and the Video Lottery Agent may, at their sole discretion, decide to take appropriate action against any person it suspects of engaging in any unlawful behavior or otherwise violating the terms of this Agreement, but is under no obligation to do so. The Delaware State Lottery and the Video Lottery Agent have no obligation to maintain account names or passwords. If you misplace, forget or lose your account name or password, the Delaware State Lottery and the Video Lottery Agent shall not be liable.
The Delaware State Lottery, and the Video Lottery Agent shall handle all personal information provided by you strictly in accordance with the Privacy Policy.
12. NO WARRANTY
THE SERVICES AND THE SOFTWARE ARE PROVIDED "AS IS". THE DELAWARE STATE LOTTERY THE VIDEO LOTTERY AGENT AND THE SERVICE PROVIDER MAKE NO WARRANTY OR REPRESENTATION, WHETHER EXPRESS OR IMPLIED (WHETHER BY LAW, STATUTE OR OTHERWISE), INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, COMPLETENESS OR ACCURACY OF THE SERVICES OR THE SOFTWARE OR INFRINGEMENT OF APPLICABLE LAWS AND REGULATIONS. THE ENTIRE RISK AS TO THE USE, QUALITY AND PERFORMANCE OF THE SOFTWARE LIES WITH YOU.
THE DELAWARE STATE LOTTERY, THE VIDEO LOTTERY AGENT AND THE SERVICE PROVIDER MAKE NO WARRANTY THAT THE SOFTWARE OR SERVICES WILL MEET YOUR REQUIREMENTS, BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SOFTWARE OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR BUGS OR REPRESENTS THE FULL FUNCTIONALITY, ACCURACY, RELIABILITY OF THE MATERIALS OR AS TO RESULTS OR THE ACCURACY OF ANY INFORMATION OBTAINED BY YOU THROUGH THE SERVICES.
IN THE EVENT OF SYSTEMS OR COMMUNICATIONS ERRORS, BUGS OR VIRUSES RELATING TO ACCOUNT SETTLEMENT OR OTHER ELEMENTS OF THE SERVICES OR RESULTING IN LOSS OF DATA BY YOU OR ANY OTHER DAMAGE TO YOUR COMPUTER EQUIPMENT OR SOFTWARE, THE DELAWARE STATE LOTTERY THE VIDEO LOTTERY AGENT AND SERVICE PROVIDER SHALL IN NO WAY BE LIABLE TO YOU AND THE DELAWARE STATE LOTTERY, THE VIDEO LOTTERY AGENT AND SERVICE PROVIDER RESERVE THE RIGHT TO VOID ALL GAMES IN QUESTION AND TAKE ANY OTHER ACTION TO CORRECT SUCH ERRORS SAVE THAT THE DELAWARE STATE LOTTERY THE VIDEO LOTTERY AGENT AND SERVICE PROVIDER ARE NOT REQUIRED TO PROVIDE ANY BACK UP NETWORK AND/OR SYSTEMS OR SIMILAR SERVICES.
IF YOU RECEIVE ANY WINNINGS OR BONUSES (OR ANY OTHER SIMILAR BENEFIT) (“BENEFITS”) AS A RESULT OF ANY ERROR MADE BY THE VIDEO LOTTERY AGENT, THE DELEWARE STATE LOTTERY OR ON EITHER OF THEIR BEHALF (WHETHER TECHNICAL OR MANUAL) IN CALCULATING, ALLOCATING OR DISTRIBUTING BENEFITS, THE VIDEO LOTTERY AGENT MAY VOID THE BENEFITS AND, TO THE EXTENT THAT YOU HAVE ALREADY RECEIVED OR BEEN CREDITED WITH A PAYMENT IN RESPECT OF THE SAME, YOU WILL REPAY THAT AMOUNT TO THE VIDEO LOTTERY AGENT OR THE VIDEO LOTTERY AGENT MAY DEDUCT IT FROM YOUR ACCOUNT.
THE DELAWARE STATE LOTTERY, THE VIDEO LOTTERY AGENTAND SERVICE PROVIDER SHALL NOT BE LIABLE FOR ANY ACTS OR OMISSIONS MADE BY YOUR INTERNET SERVICE PROVIDER OR OTHER THIRD PARTY WITH WHOM YOU HAVE CONTRACTED TO GAIN ACCESS TO THE SERVER THAT HOSTS THE SITE, TO MAKE PAYMENT DEPOSITS OR WITHDRAWALS.
13. Limitations of Liability
You agree that you are free to choose whether to use the Services and do so at your sole option, discretion and risk.
The Delaware State Lottery, the Lottery Video Agent, and their respective officers, employees, contractors, service providers, and agents, shall not be liable to you or any third party in contract, tort, negligence, or otherwise, for any loss or damage whatsoever arising from or in any way connected with your, or any third party's, use of the Software or the Services, whether direct or indirect, including, without limitation, damage for loss of business, loss of profits (including loss of or failure to receive anticipated winnings), business interruption, loss of business information, or any other pecuniary or consequential loss (even where we have been notified by you of the possibility of such loss or damage).
The Delaware State Lottery, the Video Lottery Agent, and their respective officers, employees, contractors, service providers, and agents, shall not be liable in contract, tort, negligence, or otherwise, for any loss or damage whatsoever arising from or in any way connected with your use, of any link contained on the Sites. The Delaware State Lottery is not responsible for the content contained on any Internet site linked to from the Sites or via the Services.
The Delaware State Lottery, the Video Lottery Agent, and their respective officers, employees, contractors, service providers, and agents, shall not be liable to you or any third party for any modification to, suspension of or discontinuance of the Software or the Services.
You agree that, in the event that the Software or Services fails to operate correctly as a result of, but not limited to, any delay or interruption in operation or transmission, any loss or corruption of data or communication or lines failure, any person's misuse of the Services, Sites or its contents or any error or omission in content or any other factors beyond our control:
a. we will not be responsible for any loss, including loss of winnings, that may result; and
b. if any such errors result in an increase in winnings owed or paid to you, you shall not be entitled to the winnings falling within such increase. You shall immediately inform the Delaware State Lottery of the error and shall repay any winnings credited to your account in error to the Delaware State Lottery (as directed by the Delaware State Lottery) or the Delaware State Lottery may, at its discretion, deduct an amount equal to those winnings from your account or set off such amount against any money owed to you by the Delaware State Lottery.
15. Disputes
In case of any dispute raised between players, or between players and the Delaware State Lottery or the Video Lottery Agent and related directly to the Services, the Video Lottery Agent shall use reasonable efforts to assist the players in resolving the matter in a prompt and satisfactory manner; such matters shall be managed whilst fully safeguarding the privacy of those involved. The players shall promptly attempt to resolve through good faith discussions any dispute or disagreement between them relating to their use of the Services; a matter that cannot be otherwise resolved may be escalated to the customer support team; if the customer support team fails to reach an understanding within 7 days of the matter being referred to the customer support team, the matter may be escalated to management.
If the dispute is not resolved according to the process described above, the Video Lottery Agent shall refer such dispute to the Director of the Delaware State Lottery for investigation and resolution.
In relation to any and all disputes between players, or between players and the Delaware State Lottery and the Video Lottery Agent, You accept and agree that random number generator will determine the randomly generated events required in connection with the Services and where the result shown on the Software (as installed and operated by your hardware) conflicts with the result shown on our server, the result shown on our server shall in all circumstances take precedence. You understand and agree that the records of the Delaware State Lottery and the Video Lottery Agent shall be the final authority in determining the facts related to your use of the Services and the Delaware State Lottery and the Video Lottery Agent are not required to consider any dispute You may have with regard to the Delaware State Lottery's or the Video Lottery Agent's decisions in such matters. This provision does not prejudice any rights or remedies You may have at law or in equity.
The proceedings contemplated by this section shall be as confidential and private as permitted by law. To that end, the parties shall not disclose the existence, content or results of any proceeding conducted in accordance with this section, and materials submitted in connection with such proceedings shall not be admissible in any other proceeding, provided, however, that this confidentiality provision shall not prevent a petition to vacate or enforce an award, and shall not bar disclosures required by law.
This provision does not prejudice any rights or remedies You may have at law or in equity. You hereby Consent to the jurisdiction of the State of Delaware to resolve any disputes arising out of the Services in such case the hearing shall become public.
No claims or disputes will be considered more than seven days after the date of the original transaction and all claims or disputes should be raised with the customer service department at support@delparkonline.com.
Where disputes cannot be settled between yourself and the Delaware State Lottery or the Video Lottery Agent, the applicable provisions of the Internet Lottery Regulations shall apply.
16. Duration and Termination
This Agreement shall come into force immediately upon your completion of the registration process and shall continue in force unless and until terminated in accordance with its terms.
We may terminate this Agreement and/or your account (including your username and password) immediately without notice:
a. if for any reason we decide to discontinue to provide the Services in general or specifically to you;
b. if we believe that you have breached any of the terms of this Agreement;
c. if your use of the Services has been in any way improper or breaches the spirit of this Agreement;
d. if your account is associated in any way with any existing account that has been terminated. If your account is associated with, or related to, existing suspended accounts, we may terminate your account, irrespective of the nature of this relationship, and the registration details provided on said accounts; or
e. for any other reason we see fit. Save for as otherwise provided herein, on termination of your account any balance in your account will be returned to you within a reasonable time of your request, subject always to our right to deduct any amounts owed by you to us.
You may terminate this Agreement together with your account (including your username and password) at any time by sending an email to us at support@ delparkonline.com, such termination to take effect upon the Delaware State Lottery terminating your account (including username and password), which shall occur within 7 calendar days after receipt by the Delaware State Lottery of your email on our servers, provided that you shall remain responsible for any activity on your account between sending us an email and the termination of your account by us.
On termination of this Agreement together with your account you shall:
a. discontinue the use of the Software and the Services;
b. pay all amounts due and owing to the Delaware State Lottery ; and
c. remove and permanently delete the Software from your computer equipment and destroy all related documentation in your possession, custody, power or control.
The right to terminate this Agreement given by this clause shall not prejudice any other right or remedy of either party in respect of the breach concerned (if any) or any other breach.
Upon the termination of this Agreement for any reason, except as otherwise provided in this Agreement and subject to any rights or obligations which have accrued prior to termination, neither party shall have any further obligation to the other under this Agreement.
In the event of our termination of this Agreement on account of your breach of this Agreement (including the Additional Rules) we will be under no obligation to refund to you any funds that may be in your account and you shall have no claims against us in such regard.
If you have chosen to close your account – for example, if you have self excluded yourself from any of our Software it is your obligation to abide by this restriction for the duration of the set period. If you open new account, whilst under a period of self exclusion or you are on the State Exclusion List we will close down the account as soon as detected. We are not obligated to refund to you any deposits or funds from the account that you opened while such exclusion or self-restriction was in place.
If you have previously had any issue with gaming addiction, financial difficulty, or any other such issue accounted for under our “Responsible Gaming” procedure, it is your responsibility to refrain from opening new accounts while such issue is in place. For example, if you have previously been suspended for a gaming addiction with any brand operated by the Delaware State Lottery, it is your obligation to refrain from opening new accounts in any of the brands operated by the Delaware State Lottery. If you do so, we will close all accounts as soon as detected. We are not obligated to refund to you any deposits or funds from the account that you opened whilst such issue was in place.
17. General
If any part of this Agreement shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed to be severable from the rest of this Agreement and shall not affect the validity and enforceability of any of the remaining provisions of this Agreement. In such cases, the part deemed invalid or unenforceable shall be construed in a manner consistent with applicable law to reflect, as closely as possible, the original intent of the parties.
No waiver by us of any terms of this Agreement shall be construed as a waiver of any preceding or succeeding breach of any terms of this Agreement.
Unless otherwise expressly stated, nothing in this Agreement shall create or confer any rights or any other benefits to third parties.
Nothing in this Agreement shall be construed as creating any agency, partnership, trust arrangement, fiduciary relationship or any other form of joint enterprise between you and us.
This Agreement contains the entire agreement between us and you relating to your use of the Software and the Services and supersedes any and all prior agreement between us and you in relation to the same. You confirm that, in agreeing to accept this Agreement, you have not relied on any representation except as may be expressly set forth in this Agreement.
We reserve the right to transfer, assign, sublicense or pledge this Agreement, in whole or in part.
You may not transfer, assign, sublicense or pledge in any manner whatsoever any of your rights or obligations under this Agreement.
In this Agreement, "you" or "your" or "user" means any person who uses the Services or the Software under this Agreement.
Nothing in this Agreement shall be construed so as to grant you any security interest whatsoever over the assets of the Delaware State Lottery, the Video Lottery Agent, or service provider, including for the avoidance of doubt on any amounts standing to the credit of your account(s).
18. Chat Feature
As part of your use of the Service we may provide you with a chat facility via which you will be able to communicate with other users of the Service. We reserve the right to review the chat and to keep a record of all statements made on such facility. Your use of the chat facility you are subject to the following rules:
You shall not make any statements that are sexually explicit or grossly offensive, including expressions of bigotry, racism, hatred or profanity.
You shall not make statements that are abusive, defamatory or harassing or insulting to other users of the Service.
You shall not make statements that advertise, promote or otherwise relate to any other online entities.
You shall not make statements about us, the Services or the Sites or any other Internet site connected to the government of the State of Delaware, the Video Lottery Agent, or service provider that are untrue and/or malicious and/or damaging.
If you breach any of the above provisions relating to the chat facility, we shall have the right to remove your chat privilege or temporarily or permanently terminate your account. Upon such termination the Delaware State Lottery shall refund to you any funds which may be in your account over and above any amount which may be owing to us at such time (if any).
PLEASE NOTE: When using the chat facility any personally identifiable information that you submit, can be read, collected, or used by other users of the same chat facility and could be used by third parties to send you unsolicited messages. 19. Customer Service Department and Special Promotions
For service quality assurance calls made by you to the customer service department may be recorded.
You hereby expressly consent to the Delaware State Lottery, the Video Lottery Agent, the service provider or their designated agents using the contact details provided by you on registration to occasionally contact you directly in relation to your use of the Services.
We will not tolerate any abusive behavior exhibited by users of the Service to our employees. In the event that we, in our sole discretion, deems that your behavior, via telephone, live chat, email or otherwise, has been abusive or derogatory towards any of our employees, we shall have the right to suspend or terminate your account with us and in such circumstances, we shall be under no obligation to refund to you any funds that may be in your account.
We may, from time to time, offer you special promotions. These promotions may be notified to you by various means, including but not limited to (i) email, (ii) telephone, (iii) SMS (iv) postal mail, (v) Push messages and (v) additional windows opening from within the Software.
We will provide you with an opt-out option in relation to various types of communications from us and should you choose to opt-out from communications we shall respect your wishes in such regard. <

If you are using the download form of the Software and wish to have it uninstalled you will be able to do so via the Add/Remove Programs on your computer.

22. Governing Law
This Agreement and the relationship between the parties shall be governed by, and interpreted in accordance with, the laws of the State of Delaware and you irrevocably submit to the exclusive jurisdiction of the courts of the State of Delaware to settle any disputes (including claims for set off and counterclaims) which may arise in connection with the creation, validity, effect, interpretation or performance of, or the legal relationships established by, this Agreement or otherwise arising in connection with this Agreement.
23. Player Disconnection
Casino Games
You hereby agree that in the event that the Live Casino is disconnected due to unsuitable hardware, software and/or connection configurations on your part, we shall be under no obligation to refund to you any monies and the Company will not be responsible for any loss, including loss of winnings, which may result.
For Casino Games Other Than for Live Roulette, Live Baccarat, Live Blackjack and Live Poker
Without derogating from bullet point 12 in Section 6, bullet point 4 in Section 7, bullet point 3 in Section 15 and the first paragraph of Section 23above, the following provisions will apply in the event of your disconnection from the server while playing a casino game:
(i) If no further action by you is required to complete the casino game, the final outcome shall be determined by the random number generator. Upon your reconnection to the server you can view the game’s final outcome by clicking on “My Account”, and then selecting “My History”.
(ii) If any further action by you is required to complete the casino game the random number generator will not automatically determine the final outcome. Upon your reconnection to the server, you can continue to play the game from the point immediately prior to the disconnection. You have 8 weeks from your disconnection from the casino game to complete it. If you have not completed the game by the end of such 8 week period, the game will then automatically terminate and any bets made by you relating to such game shall be deducted from your account.

24. Provisions Relating to Specific Games
Jackpot Winnings
Subject to Title, 29 § 4818, in the event of a jackpot of USD 20,000 or more in relation to the casino slots games, video slots, video poker or any other jackpot game you will be contacted by either the Delaware State Lottery and the Video Lottery Agent to gain permission to use your name, photograph and likeness in any media, in connection with the marketing and promotion of the Delaware State Lottery and the Video Lottery Agent and their Sites. If permission is granted, you will fully cooperate with our representatives in such regard.
We reserve the right, for a reasonable period of time, to review your jackpot win to ensure its validity for a period of up to 5 business days.
Poker Related Provisions
You hereby acknowledge that all bets placed by you in relation to multi-player poker games are bets placed with other players and not bets placed with or against the Delaware State Lottery. We do not assume any risk whatsoever for bets placed between you and any other user of the Service. We do not under any circumstances either place or accept bets our self.
You may not occupy more than one position at a poker table at any given time, though you may occupy one position at several tables at any given time.
You understand and agree that all of our multi-player poker games are public and therefore may be reviewed and published by other players, either at the time of the game or thereafter.
We provide multi-player poker games so as to provide a platform for players to play poker and to bet with each other using the Software. In consideration of this service we charge either:
a. a commission (known as a rake) which is calculated in accordance with the House Rules; or
b. a percentage of the "buy-in" fee for tournaments.

Collusion: Collusion occurs when two or more players attempt to gain an unfair advantage which includes but is not limited to sharing knowledge of their cards or other information and unless stated otherwise by the Video Lottery Agent, by agreeing to split a prize-pool. In cases of suspected collusion, we shall be entitled to freeze the implicated players’ accounts pending investigation, and/or notify the proper authorities of the suspected activity. Any player who colludes or attempts to collude with any other player while using the Services may be permanently banned from using the Services or the Software or any other related services, their account may be terminated immediately and we shall be entitled to retain all monies in such player's account. We have developed and employ proprietary technology intended to seek out and identify players acting in collusion. If the Delaware State Lottery is informed about suspected collusive behavior, it may, in its sole discretion, terminate suspected players' access to the Service and/or suspend their accounts and withhold all available funds from within the accounts. No player shall have the right to require the Delaware State Lottery, the Video Lottery Agent, or service provider to take any other steps against players suspected of collusion, cheating or any other form of fraud.
Chip-Dumping: Chip-dumping occurs when any player deliberately loses a hand in order to deliberately transfer his chips to another player. Any player who is involved in an act of chip-dumping or attempted chip-dumping while using the Service may be permanently banned from using the Service or the Software and such player's account may be terminated immediately. If the Delaware State Lottery is informed about suspected Chip-Dumping, it may, in its sole discretion, terminate suspected players' access to the Service and/or suspend their accounts and all monies in such player's account. In such circumstances the Delaware State Lottery, and the Video Lottery Agent will be under no obligation to refund to the relevant player any funds that may be in the account at such time.
If we have reason to suspect that an account or group of accounts are operating systematically – for example employing specific techniques or playing as a group, the Delaware State Lottery shall have the right to suspend or terminate all accounts and in such circumstances, the Delaware State Lottery, and the Video Lottery Agent shall be under no obligation to refund to you any funds that may be in your account, other than your original deposit amounts, if said amount remains.

Seating Aids: Without derogating form the prohibited use of Software Aids, you are not allowed to use any software program or external aid which, in our opinion, enables you to find a seat at a poker table or automatically seats you at a poker table (“Seating Aid”). We constantly review the use of the Services in order to detect the use of Seating Aids and in the event that we deem it has been used we reserve the right to take any action we see fit, including immediately suspending access to the Services to the offending player, terminating such player's account and seizing all monies held in such account. If the Delaware State Lottery is informed about suspected Seating Aids, it may, in its sole discretion, terminate suspected players' access to the Service and/or suspend their accounts and all monies in such player's account.
Payment Disputes: Each player of the Services is fully responsible for paying any and all monies owed by it to other users of the Services and/or the Delaware State Lottery and the Video Lottery Agent. Any claim which a user of the Services may have for payment of winnings to it in respect of losing bets placed by another user of the Services are against that other user and not the Delaware State Lottery and the Video Lottery Agent. The Delaware State Lottery and the Video Lottery Agent are in no way responsible to pay you if any user of the Services fails to pay his debts for whatever reason, or for taking any action whatsoever against such users. All disputes that arise between users of the Services, including those relating to payment fraud, are not the responsibility of the Delaware State Lottery and the Video Lottery Agent.
If your account is associated with poker fraud in any way – for example through Chip Dumping, Collusion, or the receipt of fraudulent Money Transfers – your account may be terminated, and we will be under no obligation to refund to you the funds from your account. This is irrespective of whether your account can be proven as intentionally receiving funds from a fraudulent user.
In the event of a poker fraud investigation we are under no obligation to accept any explanation provided for the receipt of fraudulent funds. If such an investigation is resolved, and your account is reopened, we may choose to remove the amount of fraudulent funds from your bankroll.
No player shall have the right to require the Delaware State Lottery or the Video Lottery Agent to take any steps against players suspected of collusion, cheating or any other form of fraud. The Delaware State Lottery and the Video Lottery Agent will not provide information with regards to investigations or any subsequent outcome. You are fully aware that there is a risk of losing money when gambling by means of the Services and you are fully responsible for any such loss. You agree that your use of the Services is at your sole option, discretion and risk. In relation to your losses you shall have no claims whatsoever against the Delaware State Lottery, the Video Lottery Agent or their service providers.
